Measures for the Administration of Licenses for the Import of Goods

Article 30 Those forging, altering or trading import licenses shall be
investigated for criminal responsibilities according to the provisions of
the Criminal Law on the crime of illegal business operation or the crime
of forging, altering or trading documents, certificates or seals of state
organs; where the circumstances are not serious enough for criminal
punishment, punishments shall be given according to the relevant
provisions of the Customs Law; and the MOFTEC may cancel their licenses
for foreign trade.
Article 31 The import licenses involved in Article 28, Article 29 and
Article 30 shall be taken over and revoked by the MOFTEC once the case is
verified to be true. For the problems involving the aforementioned
licenses found in the course of the actual supervision or case handling
by the customs, the license issuing agency shall give clear reply and
active cooperation.
Article 32 The working personnel of the license issuing agencies who
committed rule-breaking acts, which haven't constituted crimes, shall be
removed from their posts and be given administrative sanctions regarding
the seriousness of the circumstances. Where crimes are constituted, they
shall be handed over to the judicial organs for investigation of their
criminal responsibilities.
Chapter 7 Supplementary Provisions
Article 33 Where laws and regulations have other provisions on the
administration of goods of special economic zones, the bonded zones,
export processing zones, etc., those provisions shall be observed.
Article 34 The administration of import license of frontier trade shall
be carried out according to the relevant existing provisions.
Article 35 The power to interpret these Measures shall remain with the
MOFTEC.
Article 36 These Measures shall come into force on January 1, 2002. Where
any relevant administration provision is inconsistent with these
Measures, these Measures shall prevail.
